Terms and Conditions of Global Bunjang

Article 1 (Purpose)

These Terms and Conditions (hereinafter referred to as the “Terms”) govern the rights, obligations, and responsibilities between Bungaejangter Inc. (hereinafter referred to as the “Company”) and users regarding the use of services (“Services”) provided through the website globalbunjang.com operated by the Company.

Article 2 (Definitions)

① “Website” refers to the virtual space (globalbunjang.com) established by the Company using computers and other information and communication equipment to provide Services to users.

② “Bungaejangter” refers to the online marketplace platform operated by the Company in Korea for residents of Korea (bunjang.co.kr).

③ “User” means any individual who accesses the Website and receives Services provided under these Terms, including both Members and Non-members.

④ “Member” means an individual who has registered as a member on the Website and can continuously use the Services provided by the Website.

⑤ “Non-member” means an individual who uses the Services provided by the Website without registering as a member.

Article 3 (Display and Amendment of Terms)

① The Company shall display these Terms, its name, representative’s name, business address (including the address for handling user complaints), email address, business registration number, and personal information manager on the homepage for users’ reference. The content of these Terms may also be made available through linked screens from the homepage.

② These Terms may be amended to the extent they do not violate relevant laws such as the Act on the Regulation of Terms and Conditions, the Electronic Signature Act, and the Act on Promotion of Information and Communications Network Utilization and Information Protection.

③ If the Company amends these Terms in a manner unfavorable to users, it will provide at least 30 days’ prior notice. The Company will clearly compare the previous and revised contents for users’ understanding on the Website.

④ Amended Terms apply only to contracts and use of Services entered into after the effective date. For contracts and use of Services entered into before the amendment, the previous Terms will apply unless the user continues to use the Services without objection, in which case the revised Terms will be deemed accepted.

⑤ Matters not specified in these Terms or the interpretation thereof shall be governed by relevant laws and customary practices.

Article 4 (Overview of Services)

① Users may view information of certain items listed on “Bungaejangter” through the Website.

② Users may register as members to access additional features or services provided by the Company.

③ The Company does not directly provide purchase, sale, or transaction services through the Website. However, the Company may provide pathways for users wishing to purchase items to use proxy purchase services offered by partner companies.

④ Proxy purchase services are provided solely under the responsibility of the partner company. The Company does not act as an agent or intermediary for such services. Members must agree to the separate terms of service provided by the partner company to use proxy purchase services.

Article 5 (Modification and Suspension of Services)

① The Company may temporarily or permanently modify or suspend all or part of the Services for the following reasons:

• Operational or technical necessity

• Maintenance, inspection, replacement, malfunction, or failure of information and communication equipment

• Business transition, discontinuation, merger, or other circumstances making service provision difficult

• Other force majeure events

② The Company will notify members in advance via the Website or other means, except in urgent or unavoidable circumstances, in which case notice may be given afterward.

③ The Company shall not be liable for any damages to members unless otherwise specified by law.

Article 6 (Creation and Use of Accounts)

① Users may apply for membership by submitting the required information in the format specified by the Company and expressing agreement to these Terms.

② The Company will generally approve membership applications(hereinafter referred to as the “Applicants”) unless there is a valid reason for refusal, such as:

• The applicant is under 16 years of age

• The applicant has previously lost membership under these Terms

• The information provided as they create an account is false, incomplete, or incorrect

• In any other case where the process of registering as a member is deemed to have an adverse technical impact on the website.

③ A Creation and Use of Accounts is established when the Company’s acceptance reaches the applicant through the Website.

④ Members must promptly update their information via the Website if there are any changes to their registration details.

Article 7 (Membership Withdrawal and Disqualification)

① Members may terminate the service agreement at any time by requesting deletion of their account via the Website.

② The Company may restrict or suspend membership in the following cases:

• False information provided at registration

• Obstructing others’ use of the Website or misappropriating their information

• Engaging in acts prohibited by law or these Terms, or contrary to public order and morals

Article 8 (Notices to Members)

① The Company may notify members via the email address specified in advance on the Website.

② Notices to an unspecified number of members may be posted on the Website instead of individual notifications. However, matters significantly affecting a member’s transaction will be notified individually.

Article 9 (Provision of Item Information and Proxy Purchase Links)

① The Website provides English translations of item information registered by sellers on “Bungaejangter.” Unlike “Bungaejangter,” the Website does not directly provide functions for purchase, payment, delivery, return, exchange, or refund; these are provided by partner companies or third parties.

② For the convenience of Users, the Company may provide access to proxy purchase services via internal or external links. In such transactions, the parties are the user and the partner company; the Company is not a party and does not act as an agent or intermediary.

③ Prices displayed on the Website are for reference only and may differ from the final price provided by the partner company. The final price and terms must be confirmed on the partner company’s payment page.

④ If a member purchases an item through a partner company, the Company may provide order and delivery status information based on data received from the partner company. The Company does not guarantee the accuracy, completeness, or timeliness of such information.

⑤ Item information posted on the Website is based on information provided by sellers or partner companies. The Company does not guarantee the accuracy, legality, or completeness of such information and, unless it is the direct seller, does not bear responsibility for it. Users should be aware that all listed items are, in principle, intended for residents of Korea, and that overseas users may not be fully protected. Users must use such information at their own judgment and responsibility.

⑥ All issues and disputes arising from purchase, payment, delivery, return, exchange, or refund through partner companies must be resolved directly between the user and the partner company in accordance with the partner company’s terms of service. The Company bears no responsibility.

Article 10 (User Obligations)

Users must not:

• Provide false information during registration or when updating member information

• Misappropriate others’ information

• Transmit or post unauthorized information (such as computer programs) on the Website

• Infringe the intellectual property rights of the Company or third parties

• Defame or disrupt the business of the Company or third parties

• Use the Website by unauthorized methods or for unauthorized purposes

• Engage in acts prohibited by law or the Company’s Terms and Policies, or contrary to public order and morals

Article 11 (Personal Information Protection)

① The Company processes members’ personal information in accordance with its policies and complies with relevant laws such as the Personal Information Protection Act.

② The Company obtains user consent and follows legal procedures when collecting, using, or providing personal information to third parties, except in cases of legal exemption.

③ The Company establishes and operates personal information protection policies and designates a chief privacy officer to protect members’ personal information.

④ Other matters regarding personal information protection are governed by the Company’s Privacy Policy.

Article 12 (Copyright and Use Restrictions)

① Copyright and other intellectual property rights in works posted on the Website belong to their respective creators (the Company, sellers, or third parties).

② Users shall not, without the express prior consent of the rights holder, reproduce, transmit, publish, distribute, broadcast, or otherwise use for commercial purposes, or allow a third party to use, any information obtained through the Website by any means.

Article 13 (External Links and Relationship with Linked Sites)

If the Website is connected to external sites via hyperlinks (including text, images, video, etc.), the Company does not guarantee or assume responsibility for transactions between users and external sites for goods or services independently provided by such sites. This will be clearly stated on either the initial screen of the Website, a linked screen, or on any screen displayed before or after the link.

Article 14 (Governing Law and Dispute Resolution)

① The interpretation of these Terms and disputes between the Company and users shall be governed by the laws of the Republic of Korea.

② Lawsuits regarding disputes between the Company and users shall be filed with the competent court under the Civil Procedure Act of Korea.
